Corporations were first chartered by states that warily kept them on very short leashes. Corporations were often not permitted to own other corporations, donate to any political or even charitable candidate or cause, and were dissolved upon completion of the specific tasks for which they were created.

Over the last century, however, the Supreme Court of the United States has effectively thrown out all such controls, allowing corporations to become powerful self-aggrandizing entities protected by the Constitutional rights intended for human beings.

While this has been happening for a long time, it has recently been brought into focus by two radical decisions (Citizens United v. the FEC, 2010 and McCutcheon v. the FEC, 2014) which twist the First Amendment to unleash unlimited money into elections from corporations and wealthy individuals. Other parts of the Constitution have also been wildly re-interpreted to subvert laws protecting citizens health and safety and the rights of minorities.

Despite its principles of separation and balance of powers in government, the Constitution overlooked the Supreme Court, with its self-authorized power to overturn acts of Congress and with no corrective mechanism, no matter how atrocious a decision may be. It is unfortunate that the only way to reverse bad decisions by the Supreme Court is by amending the Constitution, but that is the situation.

We need to clearly affirm that "corporations are not people" and "money is not speech," and, however bizarre it may seem, the only way to do this is to amend the Constitution

This Working Group is dedicated to the adoption of Constitutional amendment, and offers a way for UU members and staff to work together to this end, and work with other organizations in the community with the same goals, notably Move To Amend and the Alliance for Democracy.
